2. Description of Services
Lendstra LLC provides business-purpose financing information, inquiry routing, and advisory or matching services that may connect business owners with independent financing providers. Lendstra LLC is not a lender, does not make credit decisions, does not guarantee approval, and does not directly fund loans. Any offer, credit decision, funding decision, rate, term, fee, or repayment obligation is determined by the applicable third-party provider.
3. Eligibility
You must be at least 18 years old and a legal resident of the United States to use our services. By using our services, you represent and warrant that you are at least 18 years old, you are authorized to act on behalf of the business identified in your inquiry, and all information you provide is accurate, complete, and current.
4. User Responsibilities
You agree not to submit false, misleading, fraudulent, or incomplete information. You are responsible for ensuring that any business, financial, ownership, contact, or other information submitted through our website is accurate and that you have the authority to submit it. You agree not to use our website or services for unlawful, deceptive, abusive, harmful, or unauthorized purposes.
5. Loan Inquiry Process
Submitting a loan inquiry through Lendstra LLC does not guarantee that you will receive a loan offer or financing. Lendstra LLC may review your inquiry and may contact you for additional information. We may also connect you with third-party lending partners or financing providers, with your consent, so they can evaluate your inquiry. Any financing offer is subject to the lender's or provider's own underwriting, verification, documentation, and approval process.
6. SMS/Text Messaging Program
Lendstra LLC may offer a service-related SMS text messaging program for users who submit a loan inquiry through our website and provide express consent to receive SMS text messages from Lendstra LLC.
By checking the SMS consent checkbox and submitting the form, you agree to receive recurring service-related SMS text messages from Lendstra LLC at the mobile number you provide. These messages may include loan inquiry confirmations, application updates, status notifications, appointment reminders, document requests, customer support responses, and other communications related to your loan inquiry.
Lendstra LLC does not use this SMS program to send marketing messages, promotional offers, coupons, discounts, sweepstakes, or unrelated advertising.
Message frequency varies. Message and data rates may apply. Consent to receive SMS text messages is not a condition of purchase, loan approval, or use of our services.
You may opt out of SMS messages at any time by replying STOP to any SMS message from Lendstra LLC. After you send STOP, we may send one final confirmation message to confirm that you have been unsubscribed, and then no further SMS messages will be sent unless you opt in again.
You may request help at any time by replying HELP to any SMS message from Lendstra LLC. You may also contact us at support@lendstra.com.
Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your mobile carrier or network operator.
SMS consent is specific to Lendstra LLC and this service-related SMS program. SMS opt-in consent is not transferable and will not be sold, rented, shared, or provided to third parties or affiliates for their own marketing or promotional purposes. Communications vendors may process the number and consent record only to provide the messaging service, document consent, or comply with law.
7. Email and Other Communications
By submitting a form or inquiry, you authorize Lendstra LLC to contact you by email, phone, or other reasonable methods regarding your inquiry, account, requested services, customer support, documentation, and related service communications. You may opt out of non-essential communications where legally available.
8. Third-Party Lending Partners and Service Providers
Lendstra LLC may work with third-party lending partners, financing providers, technology providers, customer support providers, compliance providers, and other service providers to operate our business and provide requested services. Third-party lending partners and financing providers may have their own terms, conditions, privacy policies, underwriting criteria, rates, fees, and documentation requirements. Lendstra LLC is not responsible for the acts, omissions, policies, or decisions of third-party lending partners or financing providers.
Lendstra does not represent every provider or product in the market. Suggested paths may reflect the information you submit, routing criteria, provider availability, and Lendstra's business relationships. Lendstra may receive compensation from a provider if a transaction closes or may charge a fee under a separate written advisory agreement. A suggestion is not a representation that an option is the lowest-cost or best option available. See the Financing Disclosures.
9. Credit Reports and Provider Applications
The initial Lendstra questionnaire does not itself authorize Lendstra to obtain a consumer report. A provider that needs a consumer report or separate credit application must rely on your written instructions or another lawful permissible purpose and should provide any required authorization and disclosures. Do not submit Social Security numbers, tax returns, bank statements, or identity documents through an ordinary contact form or by independently emailing them to Lendstra. A provider-specific application may request these records and will identify the receiving provider and delivery method before you submit.
10. Privacy
Your use of our website and services is governed by our Privacy Policy, which explains how we collect, use, disclose, and protect information. Our Privacy Policy is incorporated into these Terms and Conditions by reference.
11. No Financial, Legal, or Tax Advice
Information provided by Lendstra LLC is for general informational and service-related purposes only and does not constitute financial, legal, tax, accounting, or professional advice. You should consult qualified professionals before making business, legal, financial, or tax decisions.
12. Intellectual Property
The Lendstra LLC website, content, text, graphics, forms, software, workflows, logos, marks, and other materials are owned by or licensed to Lendstra LLC and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works based on our website or materials except as expressly permitted by law or written agreement.
13. Prohibited Uses
You agree not to use our website or services to violate any law, submit fraudulent information, impersonate another person or business, interfere with website security or operation, attempt unauthorized access, transmit malicious code, scrape or harvest data without authorization, or engage in deceptive, abusive, harmful, or infringing conduct.
14. Disclaimer of Warranties
Our website and services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Lendstra LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and reliability. We do not warrant that our website or services will be uninterrupted, error-free, secure, or free from harmful components.
15. Limitation of Liability
To the maximum extent permitted by law, Lendstra LLC shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, business, data, goodwill, or anticipated savings, arising out of or related to your use of our website or services. To the maximum extent permitted by law, Lendstra LLC's total liability for any claim shall not exceed the amount you paid to Lendstra LLC for the applicable service during the twelve months preceding the event giving rise to the claim, or one hundred dollars ($100), whichever is greater.
16. Indemnification
You agree to indemnify, defend, and hold harmless Lendstra LLC, its owners, officers, employees, contractors, agents, service providers, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of our website or services, your violation of these Terms and Conditions, your violation of applicable law, or information you submit.
17. Changes to Services or Terms
We may modify, suspend, or discontinue any part of our website or services at any time. We may update these Terms and Conditions from time to time. Updated terms will be posted on our website with a revised “Last updated” date. Continued use of our website or services after changes are posted constitutes acceptance of the updated terms.
18. Governing Law
These Terms and Conditions are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising out of or related to these Terms and Conditions or our services shall be handled in the state or federal courts located in Florida, unless applicable law requires otherwise.
